Cela repr\u00e9sente\u202f<strong>30 jours ouvrables (5 semaines)\u202fpour une ann\u00e9e compl\u00e8te de travail<\/strong>. Notez que l&#8217;employeur peut calculer les jours de cong\u00e9s en jours ouvr\u00e9s. Toutefois, le mode de calcul doit garantir au salari\u00e9 des droits \u00e0 cong\u00e9s au moins \u00e9gaux \u00e0 ceux calcul\u00e9s en jours ouvrables.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Le cong\u00e9 principal (le plus long cong\u00e9 de l&rsquo;ann\u00e9e pour un salari\u00e9) ne peut \u00eatre inf\u00e9rieur \u00e0\u202f<strong>12 jours ouvrables<\/strong>. Le salari\u00e9 doit le prendre entre <strong>1er\u202fmai et le 31 octobre<\/strong> (sauf avis inverse dans la convention collective). &nbsp;<\/p>\n\n\n\n<div style=\"height:17px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h2 class=\"wp-block-heading\">Les jours de fractionnement&nbsp;<\/h2>\n\n\n\n<figure class=\"wp-block-image alignright size-medium is-style-default\"><img decoding=\"async\" width=\"300\" height=\"300\" src=\"https:\/\/novalliance.fr\/wp-content\/uploads\/2022\/06\/Sans-titre-44-300x300.png\" alt=\"\" class=\"wp-image-3396\" srcset=\"https:\/\/novalliance.fr\/wp-content\/uploads\/2022\/06\/Sans-titre-44-300x300.png 300w, https:\/\/novalliance.fr\/wp-content\/uploads\/2022\/06\/Sans-titre-44-1024x1024.png 1024w, https:\/\/novalliance.fr\/wp-content\/uploads\/2022\/06\/Sans-titre-44-150x150.png 150w, https:\/\/novalliance.fr\/wp-content\/uploads\/2022\/06\/Sans-titre-44-768x768.png 768w, https:\/\/novalliance.fr\/wp-content\/uploads\/2022\/06\/Sans-titre-44.png 1080w\" sizes=\"(max-width: 300px) 100vw, 300px\" \/><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">En l&rsquo;absence d&rsquo;accord ou de convention, des jours ouvrables de cong\u00e9s suppl\u00e9mentaires, dits\u202f\u00a0\u00bb<strong>jours de fractionnement<\/strong>\u00ab\u00a0, peuvent \u00eatre attribu\u00e9s :&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>Un jour de cong\u00e9 suppl\u00e9mentaire<\/strong> est attribu\u00e9 au salari\u00e9 qui prend entre trois et cinq jours de cong\u00e9s en dehors de la p\u00e9riode du 1er\u202fmai au 31 octobre.&nbsp;<\/li><li><strong>Deux jours ouvrables de cong\u00e9s suppl\u00e9mentaires<\/strong> sont attribu\u00e9s au salari\u00e9 qui prend six jours ou plus de cong\u00e9s en dehors de la p\u00e9riode du 1er\u202fmai au 31 octobre.&nbsp;<\/li><\/ul>\n\n\n\n<div style=\"height:70px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h2 class=\"wp-block-heading\">Comment l\u2019employeur fixe la p\u00e9riode de cong\u00e9s\u202f?&nbsp;<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Les cong\u00e9s pay\u00e9s peuvent \u00eatre pris sur toute l&rsquo;ann\u00e9e. Dans tous les cas, elle comprend obligatoirement la <strong>p\u00e9riode l\u00e9gale du 1er\u202fmai au 31 octobre<\/strong>.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Dans la pratique, les salari\u00e9s proposent des dates \u00e0 leur employeur, qui reste <strong>libre de les accepter ou non<\/strong>. Une fois les dates fix\u00e9es, elles ne peuvent \u00eatre modifi\u00e9es moins d\u2019un mois avant le d\u00e9part. Des d\u00e9rogations existent en cas de circonstances exceptionnelles (par exemple, une commande de derni\u00e8re minute susceptible de sauver une entreprise menac\u00e9e de faillite).&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Pour d\u00e9finir l\u2019ordre des d\u00e9parts, l\u2019employeur tient compte des crit\u00e8res suivants\u202f:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>la\u202fsituation de famille des b\u00e9n\u00e9ficiaires<\/li><li>la\u202fdur\u00e9e de leurs services chez l\u2019employeur&nbsp;<\/li><li>Leur\u202factivit\u00e9 chez un ou plusieurs autres employeurs.<\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Durant ses cong\u00e9s, le salari\u00e9 n\u2019a pas le droit de travailler, ni pour son employeur, ni pour un autre employeur<\/strong>&nbsp;.<\/p>\n\n\n\n<div style=\"height:59px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h2 class=\"wp-block-heading\">Comment sont calcul\u00e9s les indemnit\u00e9s de cong\u00e9s pay\u00e9s\u202f?&nbsp;<\/h2>\n\n\n\n<figure class=\"wp-block-image alignleft size-medium is-style-rounded\"><img decoding=\"async\" width=\"300\" height=\"300\" src=\"https:\/\/novalliance.fr\/wp-content\/uploads\/2022\/06\/Sans-titre-50-300x300.png\" alt=\"\" class=\"wp-image-3410\" srcset=\"https:\/\/novalliance.fr\/wp-content\/uploads\/2022\/06\/Sans-titre-50-300x300.png 300w, https:\/\/novalliance.fr\/wp-content\/uploads\/2022\/06\/Sans-titre-50-1024x1024.png 1024w, https:\/\/novalliance.fr\/wp-content\/uploads\/2022\/06\/Sans-titre-50-150x150.png 150w, https:\/\/novalliance.fr\/wp-content\/uploads\/2022\/06\/Sans-titre-50-768x768.png 768w, https:\/\/novalliance.fr\/wp-content\/uploads\/2022\/06\/Sans-titre-50.png 1080w\" sizes=\"(max-width: 300px) 100vw, 300px\" \/><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">Pendant son cong\u00e9, le salari\u00e9 per\u00e7oit une\u202f<strong>indemnit\u00e9 de cong\u00e9s pay\u00e9s<\/strong>. Elle peut \u00eatre calcul\u00e9e de deux fa\u00e7ons\u202f:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>L\u2019indemnit\u00e9 est \u00e9gale \u00e0\u202f1\/10e\u202fde la r\u00e9mun\u00e9ration brute totale\u202fper\u00e7ue par le salari\u00e9 au cours de la p\u00e9riode de r\u00e9f\u00e9rence&nbsp;<\/li><li>L\u2019indemnit\u00e9 de\u202fcong\u00e9s pay\u00e9s\u202fest\u202f\u00e9gale \u00e0 la r\u00e9mun\u00e9ration que le salari\u00e9 aurait per\u00e7ue s&rsquo;il avait continu\u00e9 \u00e0 travailler.&nbsp;<\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Toutefois, c&rsquo;est le montant le plus avantageux pour le salari\u00e9 qui est pay\u00e9.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<div style=\"height:60px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h2 class=\"wp-block-heading\">Les caisses de cong\u00e9s pay\u00e9s&nbsp;<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Dans le <strong>secteur du BTP<\/strong>, ce n&rsquo;est pas l&#8217;employeur qui verse la r\u00e9mun\u00e9ration au salari\u00e9 durant son cong\u00e9 pay\u00e9. Ainsi, l&#8217;employeur cotise a la caisse des cong\u00e9s pay\u00e9s sur le bulletin de salaire. Et c&rsquo;est l<strong>a caisse qui r\u00e9mun\u00e8re le salari\u00e9 pendant son cong\u00e9.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Les droits restent les m\u00eames que pour les autres salari\u00e9s.
