C&rsquo;est une <strong>rupture amiable<\/strong>. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Cette modalit\u00e9 est venue combler une carence en droit du travail, la d\u00e9mission et le licenciement ne couvrant pas toutes les situations possibles. En effet, parfois le salari\u00e9 pouvait souhaiter rompre son CDI, mais n&rsquo;\u00e9tait pas pr\u00eat \u00e0 d\u00e9missionner, avec toutes les cons\u00e9quences d&rsquo;une d\u00e9mission. Vous, en tant qu&#8217;employeur, vous pouviez \u00eatre pr\u00eat \u00e0 le laisser partir sans pour autant le licencier. Nous le savons, engager un licenciement n&rsquo;est pas sans risque juridique.\u00a0<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Qui est concern\u00e9 par la rupture conventionnelle ?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">T<strong>ous les salari\u00e9s en CDI <\/strong>y compris un salari\u00e9 prot\u00e9g\u00e9, peuvent b\u00e9n\u00e9ficier d&rsquo;une rupture conventionnelle. Dans le cas particulier du salari\u00e9 prot\u00e9g\u00e9, vous devrez demander l&rsquo;<strong><a href=\"https:\/\/dreets.gouv.fr\/\">autorisation pr\u00e9alable \u00e0 l&rsquo;inspecteur du travail.\u00a0<\/a><\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Quelle est la proc\u00e9dure ?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">La proc\u00e9dure est d\u00e9crite de fa\u00e7on pr\u00e9cise.
