{"id":4302,"date":"2023-09-18T14:25:50","date_gmt":"2023-09-18T14:25:50","guid":{"rendered":"https:\/\/novalliance.fr\/?p=4302"},"modified":"2023-09-18T14:37:14","modified_gmt":"2023-09-18T14:37:14","slug":"how-paternity-leave-works","status":"publish","type":"post","link":"https:\/\/novalliance.fr\/en\/le-conge-paternite-comment-ca-marche\/","title":{"rendered":"How does paternity leave work?"},"content":{"rendered":"<p class=\"wp-block-paragraph\">Paternity leave consists of 2 periods.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Who is entitled to paternity leave?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The beneficiary of paternity leave may be :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the father<\/li>\n\n\n\n<li>the mother's spouse or partner<\/li>\n\n\n\n<li>the person linked to the mother by a civil partnership (Pacs).<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Leave may be granted to both the father and the person living with the mother. Gender and relationship to the child are not eligibility criteria.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">1st holiday period <\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The father must receive<strong>\u00a04 calendar days' leave immediately following the 3 calendar days' maternity leave. <\/strong>During this period, the employee's employment contract must be suspended (<a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000042679120\">Article L.1225-35-1 of the French Labour Code<\/a>). <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This leave is compulsory.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">2nd period of leave <\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Paternity leave is&nbsp;<strong>extended to 21 calendar days<\/strong>, 28 calendar days if there are several births. This leave can be taken in 2 instalments with a minimum duration of 5 days. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This leave is optional. It must be taken within 6 months of the birth.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What do I need to do?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">However, employed fathers must&nbsp;<strong>inform the employer of the dates and duration of the leave.<\/strong> The notice period is set at<strong> one month before the start of the leave<\/strong>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">To find out more<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>The compulsory 4 calendar days' paternity and childcare leave must be taken immediately after the 3 days' childbirth leave. <\/strong>And it must begin within<strong> 6 months following the birth of the child.
