{"id":4495,"date":"2024-02-20T12:12:01","date_gmt":"2024-02-20T12:12:01","guid":{"rendered":"https:\/\/novalliance.fr\/?p=4495"},"modified":"2024-02-20T12:12:03","modified_gmt":"2024-02-20T12:12:03","slug":"refusal-of-fixed-term-contracts-by-employees-on-fixed-term-contracts","status":"publish","type":"post","link":"https:\/\/novalliance.fr\/en\/refus-de-cdi-par-des-salaries-en-cdd\/","title":{"rendered":"Refusal of permanent contracts by employees on fixed-term contracts"},"content":{"rendered":"<p class=\"wp-block-paragraph\">Since 1 January 2024, the refusal of a permanent contract by employees on fixed-term or temporary contracts can lead to the dismissal of their employer. <strong>abolition of unemployment benefit<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The\u2019<a href=\"https:\/\/code.travail.gouv.fr\/code-du-travail\/l1243-11-1\">Article L1243-11-1 of the Labour Code<\/a> has introduced new provisions. As an employer, if you are faced with a refusal of permanent contract positions, you must submit a request to the French authorities. <strong>declaration on the site <a href=\"https:\/\/www.demarches-simplifiees.fr\/commencer\/refus-de-cdi-informer-francetravail\">France Travail<\/a>.<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Proposed position<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The position offered on a permanent basis meets the following conditions:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>same job<\/strong> that the employee held at the time of the permanent contract or interim assignment<\/li>\n\n\n\n<li>use of <strong>same classification<\/strong><\/li>\n\n\n\n<li><strong>identical workplace<\/strong><\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Job offer<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">From now on, you must notify <strong>in writing<\/strong> any offer of a permanent contract. This offer must be made before the fixed-term contract (CDD) or assignment contract expires.\u00a0\u00a0<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In addition, the proposal must <strong>reasonable time <\/strong>to the employee to decide. Notification may be given by <strong>registered letter with acknowledgement of receipt or hand-delivered<\/strong> against discharge.\u00a0<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Declaration of refusal of a permanent contract<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">If the employee refuses, you must make a paperless declaration to France Travail. This declaration is made by creating a space on the d\u00e9marches-simplifiees.fr website.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is important to note that this refusal may, under certain conditions, <strong>deprive the employee of entitlement to unemployment benefit.\u00a0<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In order to enable France Travail to examine the unemployment benefit claim of the employee concerned, the employer is required to complete a <strong>specific form<\/strong>.\u00a0<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Consequences of refusing a permanent contract<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">From the 2nd refusal in the previous 12 months, the jobseeker will no longer receive compensation.
